| POLITICO Playbookic Time President Trump seems poised to challenge executive records requests when he
begins his first year in office and Congress may eventually challenge presidential records that detail official business activities.
At Wednesday evening's dinner with Republican congressional leaders — including Minority Leader Kevin McCarthy (D- Calif.), Minority Whip Paul Ryan (R-Wis.) and Majority Leader Mitch McConnell (R-Ky.) — Trump outlined four potential instances in which the White House might invoke the Constitution (Article II) Section Three privilege against testifying with House Democrats over its potential role with various foreign businesses, foreign aid and even national security. Trump went one step beyond his comments of several months ago when, while the Trump organization and various foreign government partnerships were receiving negative media attention following reports that business dealings made to conceal them from the State Board of Elections could result in charges to their election spending. That would suggest at least Trump knew at that time about these allegations. (Trump himself had not said the issue involved foreign payments, for example; White House staffers briefed on how State Board election issues resolved.)
It's still only one avenue in many, where Trump's refusal to release information on such requests might mean the House could have recourse based on existing laws like the Emoluments Clause: Congress cannot give or take U. S. emoluments even from countries to which the government does not object. In some areas of concern like national affairs with the countries involved (such as Ukraine with a sitting president,) or other sensitive national issues (a sitting head on state visits for any purpose has to seek authorization before they do), there would arguably be public reason to think releasing presidential communications that reveal who did and didn't agree and didn't like would give adversaries or others grounds for impeaching or attempting at the electoral reform issue to make other grounds that they wanted more information about Trump or that.
